SAI represented E-Global, one of Mexico’s two main clearinghouses, in an investigation to determine competition barriers in the payment systems market involving clearinghouses for debit and credit card transactions, conducted by COFECE. COFECE concluded that the market under review did indeed present competition barriers. However, due to SAI’s successful intervention—representing E-Global—alongside other parties, COFECE significantly reduced the scope of its recommendations and orders compared to what was originally proposed by the investigative authority. Notably, COFECE disregarded the divestment order suggested by the investigative authority and instead ordered E-Global and its main shareholders to implement a competition compliance program within E-Global and appoint a compliance officer to oversee adherence to competition law. SAI assisted E-Global in presenting the necessary information to demonstrate to the authority that it had complied with COFECE’s orders.
